Terms and Conditions for International Shipping

Purpose of These Terms

These Terms and Conditions govern the relationship between KITOWA Co., Ltd. (“KITOWA,” “we,” “us,” or “our”), which operates the KITOWA Online Store (the “Store”), and customers who wish to have products sold through the Store (the “Products”) delivered outside Japan using “Buyee,” a proxy purchasing and international shipping service operated by tenso, Inc. (“Buyee”).

Buyee is an independent proxy purchasing and international shipping service operated by tenso, Inc.

When using Buyee, customers are also required to comply with Buyee’s own terms of use and any other applicable terms and conditions.

Purchases, payments, international shipping, and other services provided through Buyee are, in principle, handled directly between the customer and tenso, Inc.

For information regarding Buyee’s services, how to use the service, fees, shipping, payment methods, and other matters, please refer to the Buyee website. Please note that the Store may not be able to respond to inquiries regarding services provided by Buyee.

If there is any discrepancy between the conditions relating to Buyee described in these Terms and the latest terms and conditions published by Buyee, the terms and conditions published by Buyee shall prevail.

 

About Buyee

When accessing the Store from outside Japan, a Buyee shopping cart or information directing you to Buyee may be displayed on eligible pages.

By using the displayed Buyee shopping cart or related service, customers may purchase Products from the Store through Buyee.

Buyee provides various international shipping methods, payment options, and multilingual customer support.

Available countries and regions, shipping and payment methods, fees, compensation plans, and other services may vary depending on the destination, Product, and time of use. For details, please refer to the Buyee User Guide and Buyee’s applicable terms and conditions.

 

Important Information

Product Prices

Please refer to each Product page for the price of Products available for purchase through Buyee.

Prices displayed on the Store are generally shown in Japanese yen and include applicable Japanese consumption tax.

When using Buyee, additional charges may apply in addition to the Product price, including Buyee purchasing fees, international shipping fees, compensation plan fees, and other optional service fees.

Depending on the destination country or region, customs duties, import taxes, value-added tax (VAT), or other taxes and charges may also apply.

Please refer to Buyee or the relevant authorities in your destination country or region for information regarding such charges.

 

Placing an Order

Please place your order for Products through Buyee.

Based on the customer’s purchase request, Buyee purchases the Products from the Store on the customer’s behalf. The Store then ships the Products to a Buyee-designated warehouse in Japan.

Buyee subsequently ships the Products from its warehouse to the overseas address specified by the customer.

For details regarding ordering procedures, conditions of use, fees, and other matters, please refer to the Buyee User Guide.

As a general rule, inquiries regarding orders placed through Buyee should be directed to Buyee.

 

Reservations and Product Holds

The Store does not individually accept requests to reserve or hold Products purchased through Buyee.

If separate conditions regarding pre-orders or reservations are stated on the applicable Product page, those conditions shall prevail.

 

Shipping

Products purchased through Buyee are first shipped by the Store to a Buyee-designated warehouse in Japan and are subsequently shipped by Buyee to the overseas address specified by the customer.

The Store does not ship Products directly to customers at overseas addresses.

International shipping fees, available shipping methods, eligible destinations, and estimated delivery times vary depending on the destination country or region, Product, shipping carrier, and shipping conditions.

In addition, certain Products, including those containing fragrances, alcohol, or similar substances, may not be eligible for international shipping depending on their contents, the destination country or region, or the rules and restrictions of the applicable shipping carrier.

Please refer to the latest information displayed by Buyee to confirm whether a Product can be shipped internationally and which shipping methods are available.

 

Returns and Exchanges

As a general rule, Products purchased through Buyee cannot be returned or exchanged for reasons attributable to the customer.

The handling of issues such as damage, loss, incorrect Products, incorrect quantities, or other problems occurring after shipment may vary depending on the Buyee compensation plan selected by the customer.

Where applicable, please review Buyee’s return policy and compensation plans and contact Buyee directly.

However, if a Product is defective or otherwise non-conforming due to circumstances attributable to KITOWA, we may handle the matter in accordance with KITOWA’s Terms of Use and other applicable policies.

 

Payment Methods

When purchasing Products through Buyee, customers may select from the payment methods provided by Buyee.

For information regarding available payment methods, currencies, fees, and other payment-related matters, please refer to the Buyee website.

 

Order Cancellations

As a general rule, Products purchased through Buyee cannot be cancelled after an order has been placed for reasons attributable to the customer.

For cancellation conditions and further details, please refer to Buyee’s terms of use, return policy, and other applicable policies.

Please note that the Store may not be able to process cancellations directly for orders placed through Buyee, even if you contact the Store.

While we take every reasonable measure to maintain Product quality and manage inventory accurately, Buyee’s proxy purchase may be cancelled if, prior to shipment, a Product defect is identified, sufficient inventory is unavailable, the Product is found not to meet international shipping requirements, or other unavoidable circumstances arise.

 

Changes to Orders

As a general rule, once an order for Products purchased through Buyee has been confirmed, changes to the Products, quantities, delivery address, or other order details cannot be accepted.

Please refer to Buyee’s guidance regarding order changes and contact Buyee where necessary.

 

Gift Wrapping and Gift Options

When purchasing Products through Buyee, gift wrapping, gift cards, shopping bags, and other gift options offered by the Store are available only where such options can be selected through Buyee.

Certain gift services may not be available depending on the Product or the details of the order.

Gift options cannot be added or changed after an order has been confirmed. Please review your selections carefully before placing your order.

 

KITOWA Online Store Membership Services

When purchasing Products through Buyee, Buyee purchases the Products on the customer’s behalf. Accordingly, such purchases are generally treated differently from purchases made directly by the customer through the KITOWA Online Store.

As a result, some or all services and benefits offered by the Store, including membership registration, the recording of purchases in a customer’s account history, member-only services, and other benefits, may not be available.

 

Handling of Personal Information

If KITOWA obtains a customer’s personal information in connection with the use of Buyee, we will appropriately manage such information in accordance with our separately established Privacy Policy.

Personal information collected through Buyee is subject to the privacy policy and other applicable policies established by tenso, Inc.

 

Prohibited Conduct

When using the Store through Buyee, customers must not engage in any of the following conduct:

  1. Impersonating another person or entering or submitting false information.
  2. Placing an order without any genuine intention to purchase the Products.
  3. Purchasing Products for resale or any other commercial purpose.
  4. Delaying or failing to fulfill payment obligations or any other obligations.
  5. Refusing delivery, remaining unavailable for an extended period, or otherwise interfering with the normal delivery of Products.
  6. Interfering with the normal operation of KITOWA or the Store or with the provision of our services.
  7. Infringing the copyrights, trademarks, other intellectual property rights, or any other rights of KITOWA or any third party.
  8. Engaging in fraud, threats, extortion, coercion, violence, other criminal conduct, conduct contrary to public order and morals, or conduct that violates applicable laws or regulations.
  9. Making unreasonable or excessive demands beyond the scope of the services provided by KITOWA.
  10. Where the customer is a member of, or has a relationship with, an organized crime group or other antisocial force.
  11. Any other conduct that KITOWA determines to be inappropriate.

If KITOWA determines that a customer’s use of the Store falls under any of the above categories, KITOWA may refuse a proxy purchase by Buyee requested by the customer or take any other measures deemed necessary.

 

Suspension or Interruption of Services

The Store may suspend or discontinue all or part of its services due to natural disasters, epidemics or pandemics, war, terrorism, riots, the enactment, amendment, or repeal of laws or regulations, instructions or orders issued by government authorities, power outages, failures of telecommunications lines, computers, or network equipment, system maintenance, unauthorized access, disruptions or accidents involving logistics or transportation providers, labor disputes, equipment failures, or other circumstances beyond KITOWA’s reasonable control.

KITOWA shall not be liable for any loss or damage suffered by a customer as a result of such circumstances, except where such loss or damage is attributable to KITOWA.

Any suspension or interruption of Buyee’s services, systems, warehouses, international shipping services, or related operations shall be governed by Buyee’s applicable terms and conditions.

 

Governing Law

These Terms, including their formation, validity, performance, and interpretation, shall be governed by the laws of Japan.

 

Trademarks

The name “KITOWA,” the KITOWA logo, and other trademarks, service marks, and similar marks displayed on the Store are owned by KITOWA or by third parties holding the applicable rights.

Use of such marks without the permission of KITOWA or the applicable rights holder is prohibited.

Any trademarks displayed on the Store that are not owned by KITOWA belong to their respective rights holders.

 

Copyright

Copyrights and other intellectual property rights relating to text, images, illustrations, videos, audio, photographs, designs, data, and other content published on the Store website are owned by KITOWA or by content providers holding the applicable rights and are protected by copyright laws and other applicable laws and regulations.

Reproduction, republication, modification, distribution, or other use of such content without the permission of KITOWA or the applicable rights holder is prohibited.

 

Disclaimer

  1. If there is any discrepancy between the Japanese version of these Terms and any translation into another language, the Japanese version shall prevail.
  2. KITOWA shall not be liable for any loss or damage suffered by a customer arising from any dispute or other issue between the customer and tenso, Inc. or any other third party in connection with the use of Buyee, payment, international shipping, customs clearance, or any other service provided by Buyee, except where such loss or damage is attributable to KITOWA.
  3. KITOWA shall not be liable for any delay, return, disposal, or other issue affecting the delivery of Products due to laws or regulations, import restrictions, customs procedures, customs duties, or other circumstances applicable in the relevant country or region, except where such issue is attributable to KITOWA.
  4. In all other cases where KITOWA may be liable to a customer or third party for damages, such liability shall be governed by the KITOWA Terms of Use and any other applicable terms and policies established by KITOWA.

 

Severability

If any provision of these Terms, or any part thereof, is determined to be invalid or unenforceable under the Consumer Contract Act of Japan or any other applicable law or regulation, the remaining provisions of these Terms and the remaining portions of the relevant provision shall remain in full force and effect.

 

Miscellaneous

  1. If a dispute arises between KITOWA and a customer in connection with the use of the Store through Buyee and litigation becomes necessary, the Tokyo Summary Court or the Tokyo District Court, depending on the amount in controversy, shall have exclusive jurisdiction as the court of first instance.
  2. Any matters not provided for in these Terms shall be governed by the KITOWA Terms of Use and any other applicable terms and policies established by KITOWA.
